Decoding Discretion in International Environmental Law: A Study of the ITLOS Advisory Opinion on Climate Change

Later this week (on Wednesday, November 6, 2024), I will present my ongoing research at the Maastricht Foundations of Law Colloquia. This early-stage work focuses on using large language models to analyse discretion in climate change litigation.

In particular, I am examining the 2024 Advisory Opinion on Climate Change from the International Tribunal for the Law of the Sea (ITLOS). I propose a method for modelling reasoning structures using a natural-language version of reason-based logic (RBL). By employing large language models (LLMs) such as GPT-01, I aim to apply this framework to legal texts and represent the findings as networks.

The goal of my research is to assist practitioners and researchers in comparing climate litigation practices among various actors, highlighting patterns and discrepancies in their exercise of discretion.

Since this is a new research project, I would greatly appreciate any help and suggestions on how to advance this work in the future.
